These Terms of Service (“Terms”) govern your access to and use of the website matriarchstudios.com (“Website”) and any related services, including private client galleries, online ordering, and digital delivery (collectively, the “Services”), operated by Capture Memoir Studios Ltd (“we”, “our”, or “us”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or Services.

2. Use of Services

Our Services include access to private, password-protected client galleries, online viewing and ordering of photographic content, and related communication tools.
You agree to use the Services only for lawful purposes and in accordance with these Terms.

You must not:

  • Attempt to gain unauthorised access to any system, data, or account.
  • Copy, download, or distribute images or materials without explicit permission.
  • Misuse our Services for any commercial or unlawful activity.

3. Client Galleries

Client galleries are provided to clients and their authorised viewers.

  • Galleries are password-protected or invite-only.
  • Capture Memoir Studios Ltd retains discretion to remove or restrict access at any time.
  • Galleries are hosted indefinitely unless otherwise agreed, though we reserve the right to archive or delete inactive galleries after reasonable notice.

Images within client galleries remain subject to copyright protection (see Section 6).

4. Orders and Payments

All print and product orders are managed via our online gallery system (Pic-Time) but payments are processed directly by Capture Memoir Studios Ltd through our secure payment provider (e.g., Stripe). By placing an order, you agree to the payment provider’s terms and conditions.

Capture Memoir Studios Ltd is responsible for collecting and processing payments but is not liable for any delays or issues arising from third-party printing or shipping partners. All prices are listed in GBP and may change without prior notice. Orders are confirmed and considered final once full payment has been received.

5. Cancellations and Refunds

Due to the custom nature of photographic products and digital services, all sales are final.
If an order arrives damaged or defective, please notify us within 7 days of receipt at hello@matriarchstudios.com

Session fees or photography retainers are non-refundable unless otherwise stated in your individual client agreement.

6. Copyright and Usage Rights

All images created by Capture Memoir Studios Ltd are protected under the UK Copyright, Designs and Patents Act 1988.
Unless otherwise stated in writing:

  • We retain full copyright ownership of all photographic works.
  • Clients receive a limited, non-transferable licence to view, download (if applicable), and share images for personal use.
  • Commercial use or reproduction without written consent is strictly prohibited.

We reserve the right to use selected images for portfolio, marketing, or promotional purposes unless otherwise agreed in writing.

7. Privacy and Data Protection

We respect your privacy and handle all personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018.

We collect and process data such as names, contact details, and gallery information solely for providing our Services. For details, see our separate Privacy Policy.

Pic-Time and other integrated platforms operate under their own privacy terms; we encourage you to review them.

8. Third-Party Services

Our Services integrate with third-party providers (e.g. Pic-Time, payment gateways, hosting providers).
We are not responsible for any failure, outage, or loss resulting from third-party systems, though we will take reasonable steps to ensure continuity of service.

9. Limitation of Liability

To the fullest extent permitted by law, Capture Memoir Studios Ltd shall not be liable for any indirect, incidental, or consequential damages arising out of or relating to your use of the Services.

We make no warranties, express or implied, regarding uninterrupted or error-free operation.

10. Indemnity


You agree to indemnify, defend, and hold harmless Capture Memoir Studios Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees and costs) arising out of or in connection with your misuse of our services, your breach of these Terms and Conditions, or any violation of applicable laws or regulations.
